Two Federal Vioxx® Trials Delayed

The second and third federal Vioxx® cases have been postponed from March and April to May and June, respectively. In addition, a federal judge laid out the framework for selecting five Vioxx® cases from the state of Louisiana for subsequent trials.

Plaintiff Ellis Diaz’s trial was to begin March 13. He had been taking Vioxx® as a medium-term user. Charles Borowicz’s case, the first representing a long-term user, is now scheduled to begin June 12.

These long-term user cases are a stark contrast to the first federal Vioxx® case of Evelyn Irvin Plunkett, whose husband died after using Vioxx® for only one month. She is currently preparing to retry her case beginning Monday after the first verdict ended in a hung jury.
